Legislators can and must also close the "data broker loophole" on the Fourth Amendment. Last year, Montana became the first state in the U.S. to pass a law blocking the government from buying sensitive data it would otherwise need a warrant to obtain. And in 2024, Senator Ron Wyden's EFF-endorsed Fourth Amendment is Not for Sale Act passed the House before dying in the Senate. Others should follow suit to stop this end-run around constitutional protections.
